TERMS AND CONDITIONS
Purchasers of offerings (“Users”), hereby agree to the Cyber Holdings 2020 Inc. (Mission Critical Institute for Cybersecurity) Terms and Conditions (“Terms”) set forth herein. The Terms include Section I, General Terms and Conditions, Section II, Online CISSP Exam Prep Course Terms and Conditions and Section III, 100% CISSP Exam Insurance Terms and Conditions.
Section I: General Terms and Conditions
The following Terms of Service (“Terms”) govern access to and use of the Mission Critical Institute for Cybersecurity website (missioncriticalinstitute.org or mci-cyber.org) (“Website”) and any content contained within or linked to the Website (the “Service”), or any live or recorded webinar, video, sound, text, graphics, or other materials sent, received, stored or otherwise appearing in the Service (collectively referred to as “Content”).
Basic Description of the Service
Mission Critical Institute for Cybersecurity, LLC (Mission Critical Institute for Cybersecurity) a cybersecurity learning organization that provides Users access to various study tools and courses that promote cybersecurity career advancement.
Users participating in Live Webinars agree to permit Mission Critical Institute for Cybersecurity to offer access to recordings of these Live Webinars to other Users. Privacy
To prevent unauthorized access, maintain data accuracy and ensure the appropriate use of information Mission Critical Institute for Cybersecurity gathers about Users (“Information”), Mission Critical Institute for Cybersecurity has taken commercially reasonable steps to protect the “Information”. Because no method of transmission over the Internet, or method of electronic storage, is 100% secure, Mission Critical Institute for Cybersecurity does not guarantee 100% protection of the Information.
Services Usage Fees
Users may access free Services or paid Services. Users may upgrade from a Free Service to a Paid Service through purchases on the Mission Critical Institute for Cybersecurity website. Mission Critical Institute for Cybersecurity reserves the right to change the Services and the payment structure at any time without prior notice.
Users must make all payments for Services through PayPal. PayPal processes and stores all credit card data. All Users agree to comply with PayPal terms and conditions. By agreeing to these terms, Users agree to be bound by the PayPal Services Agreement which PayPal may modify from time to time. As a condition of Mission Critical Institute for Cybersecurity enabling payment processing services through PayPal, Users agree to provide Mission Critical Institute for Cybersecurity accurate and complete information about Users and Users’ businesses, and Users authorize Mission Critical Institute for Cybersecurity to share all transaction information related to Users use of the payment processing services provided by PayPal. In the event the system does not process a User’s payment, the User will not receive access to the Content or Service.
Security and Use of Services
In the live webinar version of the Service, communication to and among participants is recorded. Without expectation of compensation or other remuneration, now or in the future, participants/users give consent to and permit Mission Critical Institute for Cybersecurity and its affiliates and agents, to use webinar recordings and/or any interview statements from users in its publications, advertising or other media activities (including the Internet). This user consent includes, but is not limited to:
(a) Permission to interview, film, photograph, tape, or otherwise make a video reproduction of participants/users and/or record participants/users voices;
(b) Permission to use participant/user first name and last initial; and
(c) Permission to use quotes from the webinar, interview(s) (or excerpts of such quotes), the film, photograph(s), tape(s) or reproduction(s) of participants/users, and/or recording of participant/user voice, in part or in whole, in its publications, in newspapers, magazines and other print media, on television, radio and electronic media (including the Internet), in theatrical media and/or in mailings for educational and awareness.
This consent is given in perpetuity, and does not require prior approval by customer, users, or students.
Restrictions on Content and Use of the Service
Mission Critical Institute for Cybersecurity reserves the right at all times (but does not have an obligation) to remove or refuse to distribute any Content on the Service and to terminate access if duly obligated. Mission Critical Institute for Cybersecurity also reserves the right to access, read, preserve, and disclose any information as Mission Critical Institute for Cybersecurity reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to User support requests, or (v) protect our rights, property or safety, our Users and the public.
The Service is for legitimate individual use only. Mission Critical Institute for Cybersecurity may at its option, terminate the Mission Critical Institute for Cybersecurity relationship with Users, or suspend Users’ access to the Service immediately if it is deemed by Mission Critical Institute for Cybersecurity at its sole discretion that Users are using Users’ subscription contrary to these Terms. Mission Critical Institute for Cybersecurity will attempt to provide Users with notice of improper usage before suspension or termination of Users’ subscription and may, if appropriate, offer Users an alternative service.
Mission Critical Institute for Cybersecurity reserves the right to report illegal activity to appropriate authorities.
Dispute Resolution
All disputes arising out of or related to these Terms shall be resolved through mediation conducted in Fairfax County, Virginia in accordance with its commercial rules. In no event shall the demand for arbitration be made more than thirty (30) days after the claim or cause of action arises. Any arbitration shall be conducted in accordance with the Commercial Rules of the American Arbitration Association then in effect, to include right of discovery. The party losing at arbitration shall be responsible for all arbitration costs, including attorney fees, for both parties. In no event shall arbitrator award exemplary or punitive damages to either party. Arbitration shall take place in Fairfax, Virginia.
Limited Liability
For the User to obtain the benefit of the services offered by Mission Critical Institute for Cybersecurity on its websites and various venues, the User agrees to limit Mission Critical Institute for Cybersecurity’s liability arising from the User’s professional acts, errors or omissions such that the total liability of Mission Critical Institute for Cybersecurity shall not exceed Mission Critical Institutes’ total fees for the services paid by the User to Mission Critical Institute for Cybersecurity for the services rendered by Mission Critical Institute for Cybersecurity.
Entire Agreement
These Terms are the entire and exclusive agreement between Mission Critical Institute for Cybersecurity and Users regarding the Services.
Mission Critical Institute for Cybersecurity retains the right to create limits on use and access at its sole discretion at any time without prior notice to Users.
Section II: Mission Critical Institute for Cybersecurity Online CISSP Exam Prep Course Terms and Conditions
These terms and conditions supplement the General Terms and Conditions set forth herein and bind all Users purchasing the Mission Critical Institute for Cybersecurity Online CISSP Exam Prep Course (“Course”).
Payment Policy: Payment must be made in full, only through PayPal, prior to the start of the Course. Users must accept all terms and conditions set forth herein prior to processing of payment.
Refund Policy: Users receive no refunds after completing a purchase of the Course.
Login Agreement: Access to the Course is limited to the single user (“User”) who purchased the Course and agreed to the Terms set forth the herein. The login to the Course assigned to the User may only be used by the User and is linked to the User’s email address submitted by the User when purchasing the Course. Any unauthorized access results in immediate termination of User access. User’s legal name is required in the appropriate field. User may access the Course for a period of 16 weeks following the purchase date.
Non-transferrable: The User may not transfer or share access to the Course with any other individual, organization or entity. The Course access is non-transferrable. In the event access to the Course has been transferred, the User’s access will be deactivated, and no refunds will be paid.
Copyright Infringement and Intellectual Property: All Mission Critical Institute for Cybersecurity courses are copyrighted. Any unauthorized duplication is not allowed. All Intellectual Property Rights in the Services are, and remain, the intellectual property of Mission Critical Institute for Cybersecurity, including adaptations or customizations.
No CISSP Exam Pass Warranty
Mission Critical Institute for Cybersecurity does not guarantee that any User will pass the CISSP exam.
Section III: 100% CISSP Exam Insurance Terms
Service
Mission Critical Institute for Cybersecurity CISSP Exam Insurance (“Insurance”) reimburses Users, who meet all the Terms set forth in Section III herein, for one retake of their CISSP Exam, following a complimentary repeat of the Course. Reimbursement for the second CISSP exam fee shall not exceed the official (ISC)2 2018 CISSP exam fee ($699.00).
Eligibility
Users must purchase the Insurance within 72 hours of their purchase of the Course.
Non-transferrable
The Insurance is non-transferrable. The Insurance may only be utilized by the individual who purchases both the Course and the Insurance. Individuals who share login information will automatically invalidate the Insurance.
Insurance Activation
Mission Critical Institute for Cybersecurity will only honor insurance activation requests from Users who have purchased the Course and the Insurance and who have satisfied all the Terms set forth herein.
To activate Mission Critical Institute for Cybersecurity CISSP Exam Insurance Users must:
- Satisfactorily complete the Course no later than 60 days following the purchase of the Course.
- Send to Mission Critical Institute for Cybersecurity the official results of User’s first CISSP exam no later than 10 days following the receipt of (ISC)2 CISSP Exam results.
- At no charge, complete the Course a second time within 12 weeks of receipt by Mission Critical Institute for Cybersecurity of the official (ISC)2 results of first CISSP exam completed by the User.
- Retake the CISSP Exam no later than two weeks following repeat of the Course.
- Within 10 days of completing the second CISSP Exam, send the official (ISC)2 results of User’s second CISSP Exam to Mission Critical Institute for Cybersecurity via PasstheCISSP@mci-cyber.org.
Insurance Reimbursement
- To obtain the CISSP Exam Insurance reimbursement, submit the results of User’s second CISSP exam to Mission Critical Institute for Cybersecurity via PasstheCISSP@mci-cyber.org.
- Within 45 days of receipt by Mission Critical Institute for Cybersecurity of User’s official (ISC)2 CISSP exam results (of User’s second exam), Mission Critical Institute for Cybersecurity determines whether the User has met all the terms and conditions set forth herein.
- After Mission Critical Institute for Cybersecurity determines that the User has met all the terms and conditions set forth herein, Mission Critical Institute for Cybersecurity will activate User’s insurance and reimburses User within 30 days for the 2018 (ISC)2 exam fee ($699).
Satisfactory Completion of the
To satisfactorily complete the Course Users must:
- Complete the Course with a minimum of 50 hours of logged study online within the Mission Critical Institute for Cybersecurity designated Learning Management System within a minimum of 10 weeks and a maximum of 17 weeks
- Participate in ten (10) Mission Critical Institute for Cybersecurity scheduled live instructor coaching sessions with (ISC)2 Certified instructor as part of the Course
- Insert answers to all 400 sample questions in the comments section of each session
- Submit a CISSP Exam Prep course evaluation to Mission Critical Institute for Cybersecurity within one week of Course completion
No CISSP Exam Pass Warranty
Mission Critical Institute for Cybersecurity does not guarantee that any User will pass the CISSP exam.
Non-discrimination Statement
Mission Critical Institute for Cybersecurity does not discriminate against individuals based on race, color, religion, sex, sexual orientation, gender identity, national origin, ancestry, age, disability, veteran status or any other category protected under applicable law in the administration of its educational policies.
